When you are facing the end of a marriage, working with an experienced Long Island divorce lawyer can help you understand your rights and navigate New York’s divorce laws. New York allows fault-based and no-fault divorces.

Most couples today choose the no-fault option by citing an “irretrievable breakdown” of the marriage for at least six months. However, fault grounds still exist and may be relevant in certain cases, including those involving cruel and inhuman treatment, abandonment for at least one year or adultery.

To file in New York, parties must meet residency requirements. Generally, at least one spouse must have lived in the state for a continuous year before filing, and the marriage must have a connection to the state (i.e., it took place in New York, the married couple lived there or the cause of action arose in the state).

Alternatively, if both spouses are New York residents when the case begins, no minimum duration is required. These rules apply equally across Nassau and Suffolk counties.
