Our Attorneys Guide Clients Through The Marriage Dissolution Process
When you are facing the end of a marriage, working with an experienced Long Island divorce lawyer can help you understand your rights and navigate New York’s divorce laws. New York allows fault-based and no-fault divorces.
Most couples today choose the no-fault option by citing an “irretrievable breakdown” of the marriage for at least six months. However, fault grounds still exist and may be relevant in certain cases, including those involving cruel and inhuman treatment, abandonment for at least one year or adultery.
To file in New York, parties must meet residency requirements. Generally, at least one spouse must have lived in the state for a continuous year before filing, and the marriage must have a connection to the state (i.e., it took place in New York, the married couple lived there or the cause of action arose in the state).
Alternatively, if both spouses are New York residents when the case begins, no minimum duration is required. These rules apply equally across Nassau and Suffolk counties.
Comprehensive Legal Support For Your Long Island Divorce
When you retain our services for your divorce in Suffolk County or Nassau County, we will provide detailed guidance on every aspect of your case, such as the issues below.
Contested Vs. Uncontested Divorce
In an uncontested divorce, spouses agree on all parenting and financial terms, while a contested divorce involves disputes that require negotiation, mediation or court intervention.
Division Of Marital Property
New York’s equitable distribution law requires judges to determine what is a fair division of marital property if the spouses cannot reach a settlement.
Spousal Maintenance (Alimony)
Sometimes referred to as alimony or spousal support, maintenance may be temporary or long-term, depending on income disparities, length of the marriage and each spouse’s financial circumstances. We have created a calculator.
Child Custody And Visitation
Custody orders address parental decision-making authority, the child’s residential arrangements and visitation schedules.
Child Support Obligations
New York’s Child Support Standards Act sets guidelines for payments from one parent to another when they live apart, factoring in income, parenting time and the children’s needs. We have created a calculator.
Divorce Mediation And Collaborative Divorce
These alternatives to traditional divorce trials promote cooperative problem-solving to help spouses move forward in a civil manner. At our firm, these are done in connection with, never in place of, a divorce. The supreme court strongly encourages divorce mediation in some counties.
Legal Separation
Couples may choose separation to resolve financial and parenting issues while remaining legally married.
Protecting Your Financial And Parental Rights
Effective representation gives you the best chance at a fair division of assets and a parenting plan that helps you maintain strong bonds with your children.
Prenuptial And Postnuptial Agreements
These contracts define financial terms if the couple gets divorced and can avert lengthy legal battles when executed properly.
Domestic Violence
Courts can issue orders of protection and take safety concerns into account when determining custody and support. We will vigorously assert your rights on all these matters as we pursue the best outcome possible for your divorce.
