Ashley St. Clair Seeks to Resolve Musk Paternity and Custody Issues in New York Court

Disagreements over paternity and child support can become very messy, even if the purported father is the richest man in the world. When the parties are from different states, that can make the situation even more complex.

Elon Musk, the billionaire entrepreneur and CEO of Tesla and SpaceX, has been ordered to appear in a New York City court as part of a legal dispute with Ashley St. Clair over their 5-month-old child, referred to in court documents as R.S.C. An author and conservative influencer, St. Clair is seeking sole custody of her son, as well as an order declaring Musk’s legal paternity and requiring him to pay child support. A hearing is scheduled for May 29.  

Justice Jeffrey H. Pearlman will also consider arguments regarding whether Musk should be compelled to take a DNA test that would determine if he is the biological father of R.S.C. Before a court can order child support or establish father’s rights, paternity must be legally confirmed. According to St. Clair’s attorney, Karen B. Rosenthal, Musk has not accepted service of the legal documents, despite efforts to give them to him personally and through his attorneys. Rosenthal noted that her client was trying to avoid a situation where Musk might have to be served at The White House, where he has been working as a presidential adviser.     

To support her claim, St. Clair submitted text messages where Musk seemed to acknowledge parentage of the infant shortly after his birth. While Musk spent time with R.S.C. in September and November, St. Clair alleges that the billionaire has not seen the baby in several months. 

This case highlights the complexities that can arise in custody and child support disputes, particularly when the parents are from different states. Jurisdictional issues can complicate the legal process, as courts must determine which state’s laws apply and where the case should be heard. In this instance, the case is being handled in New York, where St. Clair resides, but Musk’s legal team may argue for a different venue.
