Dix Hills, NY (Lexis Nexis) March 26, 2009 -- In the latest in a series of appellate court victories on behalf of divorced clients seeking permission to relocate with their children out of New York, Bryan Salamone prevailed recently in a Suffolk County relocation case that resulted in the Court granting his client permission to move to Florida with her child, leaving the father in New York.
The case, Wirth v. Wirth (Docket Nos. V-14928-05, V-15046-05), was resolved by the Supreme Court of the State of New York, Appellate Division's Second Judicial Department. Salamone's client, who was divorced from her husband in 2005, had sought permission from the Suffolk County Family Court to move with the couple's child from Long Island to Florida, for economic reasons and for family support. The family court denied that permission, so Salamone appealed the decision to the appellate court and won.
"It has just become standard practice here in Suffolk County for the family courts to deny relocation to a parent with their children, even though oftentimes this is the only realistic way that the parent can afford their living expenses," explained Salamone, whose entire law practice is devoted to divorce and family law. "However, our firm has developed a winning strategy that has resulted in a number of successful appeals to the State of New York's Appellate Division, reversing the orders from the Suffolk County Family Court and allowing our clients to relocate with their children. The appellate court is clearly sending a message to the Long Island Family Courts to stop being so tough on relocation and is blazing this trail on behalf of our clients."
Salamone's firm is highly regarded for its aggressive yet personal approach and has earned the firm a reputation for excellence among clients, judges and adversaries. Salamone handles a wide range of divorce and family law matters, preparing effective litigation strategies and plans of attack to produce the results their clients are seeking.
